Privacy Policy of SailSafe OÜ

Introduction

The technology platform located at www.yachtwisely.com (the Site) is owned and operated by OÜ SailSafe (registry code 16812467, address at F. R. Kreutzwaldi tn 24 // Tartu mnt 43, 10128 Tallinn, Estonia) (SailSafe). The Site as a technology platform, is a point of contact, where the Site user can find information about services related to the insurance and management of various types of watercrafts (the Services). The Services are offered by independent service providers (the Service Providers) as explained in the terms and conditions (see here).

By using the Site and providing personal data, the data subject is accepting the practices described in this privacy notice. If the data subject does not wish to share personal data with SailSafe and Service Providers and the latter's processors, the data subject should refrain from using the Site.

Personal data

Personal data is any information relating to a natural person (identified or identifiable). SailSafe processes the following personal data: name; e-mail address; phone number; residence and billing address; IP address and location data; information about watercraft, including name, registration number; information related to international sanctions; other information provided via the form available on the Site, chat application on the Site or emails to SailSafe, collecting of which is not the desire nor purpose of SailSafe, but about which the latter might learn if and when provided to SailSafe.

Source of personal data

SailSafe gets the above-described personal data mainly directly from the data subject who uses the Site and provides personal data via the form provided on the Site or contacts SailSafe via chat application available on the Site or email.

Purpose of processing

Provision of information society service through the Site as described in the Site's terms and conditions (see here); settling claims deriving from usage of the Site; responding to inquiries; marketing activities, e.g. sending ads and offers; fulfilling obligations deriving from the law (international sanctions); bettering service provision via Site and Site functionality.

Legal basis of processing

Processing is necessary to take steps at the request of the data subject prior to concluding a contract between the data subject and the Service Provider. SailSafe needs to process personal data to provide information about the services through the Site and offer technical assistance regarding the contracts between the data subject and the Service Providers. It is not possible to provide information about such third-party services or technically assist in the process of concluding a contract, without processing personal data.

Legitimate interests of SailSafe, incl. responding to data subjects' requests (made via chat application available on the Site or via email), marketing activities, settling claims, bettering the Site's functionality and services offered via Site. SailSafe cannot respond to inquiries made by the data subject without processing personal data. Therefore, data processing is in the interest of the data subject. In addition, it is in the interest of the data subject that SailSafe deals with claims submitted by the data subject and from time to time betters the Site's functionality and services offered via Site.

Fulfillment of an obligation deriving from the law (incl. determining limitations deriving from international sanctions).

Disclosure of personal data

In addition to SailSafe, personal data will be processed by the Service Providers as described in their privacy policy and may be processed by SailSafe's processors.

Processors used by SailSafe support the activities of SailSafe, by offering services without which SailSafe cannot administer the Site and offer services. Such services are for example: handling e-mail (Sendgrid.com); webpage and server hosting (Amazon.com); accounting services; other administrative services, like document generation (Carbone.io); legal and payment solution services (Insly.com). As described, SailSafe's services are provided using third party platforms and applications and data subject should read third party privacy statements as they are different from this privacy policy.

SailSafe may be obliged to disclose personal data to governmental and administrative bodies (data protection authorities, police, courts, tax and customs boards etc) as such obligation may derive from the law.

In case SailSafe must disclose the personal data to countries or companies outside European Economic Area, SailSafe will follow necessary requirements provided by the applicable law.

Data retention

SailSafe will retain personal data based on processing purposes and the legal basis of the processing. Considering possible various communications and their subject matter between data subject and SailSafe and obligations deriving from applicable law, it is not possible to exhaustively list all the retention periods, but SailSafe provides the criteria of determining the retention periods. The following should not be interpreted as an exhaustive list.

SailSafe stores the personal data submitted via the form on the Site (except regarding yacht management services) and personal data regarding the provision of technical assistance as described in the terms and conditions of the Site, six (6) months after the insurance policy has expired, if the insurance is bought using the Site; personal data will not be stored longer than 30 days, if no service is purchased using the Site and there is no communication initiated by the data subject; In case of a legal dispute, personal data will be stored until the dispute is resolved.

In all other cases, if the applicable law does not provide any mandatory storage time, SailSafe will store personal data throughout time limit data subject or SailSafe my file claims against the other party.

Data subject's rights

Data subjects have the right to access the data that SailSafe holds about them. Data subject may request the rectification of inaccurate personal data and erasure of personal data and data subject has the right to object to data processing, if the prerequisites set in relevant regulations are fulfilled. On certain occasions data subject may request a restriction on further processing of its personal data by SailSafe.

To exercise any of the above-described rights data subject can send an email to SailSafe with a specific request at sailsafeprivacy@yachtwisely.com. SailSafe will respond within thirty (30) days.

Data subject may file a claim to court or supervisory authority.


This privacy policy is subject to changes deriving from the applicable law and SailSafe's business and practice. Up to date version of this privacy policy will always be published in the Site.
